김건희 여사 '출장조사' 특혜 아니다 - 박성재 법무부장관  

 

2024년 7월31일. 김건희 여사의 '출장조사'에 대해 박성재 법무부 장관은 '문제될 것 없다'는 입장을 표명했다. 박 장관은 31일 국회 법제사법위원회 전체 회의에서 ‘이원석 검찰총장이 김 여사 조사 과정에서 법 앞에 예외도 특혜도 성역도 없다는 원칙이 지켜지지 않았다며 국민에게 사과한 것'에 대해 “(이 총장이) 원칙을 어겼다는 부분이 무엇인지를 모르겠다”며 "특혜라고 생각하지 않는다"라고 답했다. 특혜가 아닌데 "원칙" 발언을 한 것에 대해 징계를 해야 하는 것 아닌가라는 이건태 의원의 질문에 그는 "답하기 어려운 질문"이라고 말했다.

박 장관은 자신도 김 여사 소환 사실을 사후에 보고받았다고 말했다. ‘조사 당시 검사들이 휴대전화를 반납한 것이 굴욕 아니냐’는 이 의원의 질문에는 “경호와 관련한 부분은 제가 언급할 내용이 아니다”라고 역시 답을 피했다.

박 장관은 김건희 여사가 연루된 도이치모터스 주가 조작 사건에 대한 검찰총장의 수사 지휘권을 복원해달라는 이 총장의 요청을 거절한 것과 관련해서는 “저는 개인적으로 수사 지휘권은 행사하지 않는 것이 옳다는 생각을 갖고 있고 인사청문회 때부터 똑같은 말씀을 드렸다. 지휘권은 개인에게 하는 것이 아니라 기관이 기관에 대해 하는 것”이라며 “해당 사건이 종결될 때까지 유효하다”고 덧붙였다.

 

박 장관이 다른 사안에 대해 답변을 하는 중 장경태 의원이 "저것을 계속 듣고 있어야 하냐"고 정청래 위원장에게 항의하자 박 장관은 "국무의원에게 '저것'이 뭐냐"고 거칠게 항의했고 이에 정 위원장은 "속기록을 보니 여기서 '저것'은 박 장관을 지칭하는 게 아니고 '저 발언'이라는 의미다. 박 장관이 다소 오해할만한 발언이기는 하나 '저것'은 박 장관이 아니니 오해 없으시길 바란다"라고 장내를 정리했다. 박 장관도 곧바로 받아들였다. 

 

 

국민권익위원회, 서울중앙지검도 '위반 사항 없음'으로 결론 내리는 분위기  

 

2024년 7월31일. 윤석열 대통령이 배우자 김건희 전 코바나컨텐츠 대표의 명품 가방 수수 사실을 신고하지 않았다고 검찰에 회신했다. 직무 관련성이 없다는 논리를 사용해 신고 의무가 없다고 주장한 것이나 다름 없다. 대통령실은 윤 대통령이 이 사실을 신고하지 않았다는 취지로 서울중앙지검에 답변했다. 청탁금지법에 따르면 공직자는 배우자의 금품 수수 사실을 알게 되면 소속 기관장에 신고해야 한다. 그러나 윤 대통령의 경우 본인이 기관장이기 때문에 신고 여부에 대한 해석이 분분하다. 국민권익위원회는 김건희 전 대표의 명품백 수수 사실에 대해 '위반 사항 없음'으로 결론 내린 바 있다.

2024년 7월30일. 대통령실이 윤석열 대통령의 배우자 김건희 여사를 보좌하는 제2부속실 설치를 추진 중이라고 조선일보가 보도했다. 대통령실 고위 관계자는 제2부속실 설치 준비가 진행되고 있으며, 이는 대통령의 지시에 따른 것이라고 밝혔고 조선일보는 전했다. 윤 대통령은 지난 2월 제2부속실 설치를 검토 중이라고 했다. 임기 초반에는 효율화를 이유로 설치하지 않겠다고 했으나, 김 여사 관련 논란과 여권의 필요성 제기로 방침을 변경했다. 대통령실은 제2부속실장 인선 작업을 마무리 중이며, 특별감찰관도 국회 추천 후 임명할 계획이다.

 

제2부속실장 후보로 장순칠 현 시민사회2비서관이 물망에 올랐는데 그는 국민의힘 이양수 의원의 보좌관 출신으로, 윤석열 대통령이 검찰총장에서 물러난 후 대선 출마를 준비하던 초기부터 함께 활동했다. 지난해 12월에는 국정기획비서관실 선임행정관에서 시민사회수석실 국민공감비서관으로 승진했고, 이후 시민사회2비서관으로 개칭됐다. 장 비서관은 제2부속실 설치와 관련해 김건희 여사를 보좌하는 역할을 맡게 될 것으로 예상된다.

 

조국혁신당은 논평에서 "제2부속실 설치로 무엇을 어떻게 하겠다는 건지 알 수가 없다. 제2부속실이 김 여사의 새벽 3, 4시의 끊임없는 카톡을 막을 수 있을까? 김 여사에게 명품백을 드릴 때는 굳이 카톡 먼저 하지 말고 제2부속실로 바로 가져오라는 말인가? 무엇을 숨기려 제2부속실을 설치하겠다는 건가? 주가조작, 고속도로, 명품백을 넘어 참으로 공손하기도 한 검찰의 출장조사까지, 국민들의 분노를 이 지경까지 키워 놓고 제2부속실이라니 가당치도 않다. 국민이 원하는 건 제2부속실 설치가 아니다. 도이치모터스 주가조작, 양평고속도로 특혜, 명품백 수수, 관저리모델링 수의계약, 상습 위조이력서, 전시회 뇌물성 후원 등 일일 나열하기도 버거운 김건희 여사를 둘러싼 모든 의혹이 만천하에 명명백백히 드러나는 것이다. 김건희 여사 종합 특검밖에 방법이 없다"라고 논평했다. 

 

개혁신당은 "늦어도 너무 늦었고, 이미 정국은 온통 '여사 논란'에 휩싸여 있다. 그러나 소를 잃었더라도 외양간을 고쳐놔야 다음 소는 잃지 않는 법이다. 이제라도 김 여사가 영부인으로서 품격을 지키고, 논란이 되는 행보를 하지 않도록 공적 관리를 하는 것은 반드시 필요하다. 단순 보좌가 아닌 필요하다면 코치의 역할도 과감히 해야 할 것이다. 제2부속실 설치만으로 '김건희 논란'이 완전히 종식되기는 어려울 것이다. 그러나 적어도 상황이 더 악화되는 일을 막는 브레이크 역할은 기대한다."라고 논평했다.

2024년 7월24일. 윤석열 대통령의 배우자 김건희 여사는 최근 '검찰청장 패싱' 서울중앙지검 조사에서 최재영 목사와 연락을 주고받은 이유에 대해 "최 목사는 동향 사람이니 '쥴리 의혹'에 대한 억울함을 이해해줄 것 같았다"고 진술한 것으로 23일 조선일보 보도에 의해 알려졌다. 김 여사는 최 목사와의 인연을 설명하며, 가족사와 관련된 이야기를 나누면서 신뢰를 쌓았다고 밝혔다. 또한, 김 여사는 "어릴 적 부족함 없이 자랐고, 집안 분위기도 보수적이어서 술집 접대부로 일할 수 없는 환경이었다"고 덧붙였다. 검찰 조사 과정에서 명품 가방 수수 의혹도 해명했다. 검찰총장 패싱 비공개 소환 조사에 대해 야권에서는 특혜 논란이 일었다. 이원석 검찰총장은 "특혜와 성역이 없다"는 원칙이 지켜지지 않았다고 사과하며, 최선을 다하겠다고 약속했다. 보수 언론을 이끌어가는 조선일보와 동아일보는 윤석열 대통령의 아내인 김건희 여사의 뇌물수수 의혹과 관련되어 거센 비난을 가한 바 있다. 

 

동아일보의 이기홍 대기자는 “대선 4개월 반 전 김 여사는 눈물을 흘리며 ‘아내로서의 역할에만 충실하겠다’고 약속했다. 그런데 취임 4개월이 지난 시점인 영상 속 모습은 약속과는 달라 보인다.”고 썼다. 영상은 한국의 인터넷 언론인 서울의 소리가 미주 한인 목사인 최재영 목사를 지난해 9월 13일 서울 서초동 아크로비스타 소재 김 여사의 코바나컨텐츠 사무실을 방문하도록해 김 여사에게 300만 원 상당의 명품 가방 ‘디올’을 선물하면서 포착한 영상을 의미한다. 서울의 소리는 최 목사가 서울의 모 백화점에서 명품 가방을 구입하는 장면부터 김 여사에게 해당 가방을 건네는 장면까지 몰래 카메라에 담았다. 유튜브 매체 ‘서울의 소리’가 지난 11월27일 동영상으로 공개하면서 김 여사 명품 가방 수수 논란 의혹이 불거졌다.

 

이 사건과 관련 동아일보 대기자는 “쉬쉬하고 넘어간다면 앞으로 전국의 공직자 배우자들에게 어떻게 김영란법 준수를 요구할 수 있겠나. 국민권익위는 왜 존재하는 기관인가. 신속히 진상 조사에 착수해 금품을 준 쪽과 김 여사 쪽 모두의 법 위반 여부를 엄정히 조사하는 것이 직분 아닌가. 이번 파문은 정권교체를 열망하며 한 표 한 표 벽돌을 쌓듯이 정권교체를 이뤄낸 국민에게 배신의 상처를 안겼다. 진심 어린 사과와 근신의 자세, 배우자 논란의 소지를 원천차단할 안전장치 마련 없이는 이를 치유할 방법이 없다.”라고 강한 주장을 펼쳤다. 

 

조선일보의 양상훈 주필은 칼럼에서 “우리 사회에서 ‘대통령 부인’이란 자리 자체가 기본적으로 갖고 있는 것이 있다. 그리 호의적이지 않고 잘못을 찾는 듯한 외부의 ‘시선’이다. 자신이 한 일, 어느 경우엔 하지도 않은 일에 대한 ‘책임’도 따라온다. 대통령 부인에겐 기본적으로 없는 것도 있다. 하고 싶은 것을 하고, 입고 싶은 것을 입고, 말하고 싶은 것을 말하고, 누리고 싶은 것을 누리고, 누구에게 주고 싶은 것을 줄 그런 ‘자유’가 없다. 그런데 지금 자유는 있고 책임은 없는 것은 아닌지 많은 사람이 걱정하고 있다.”라고 썼다. 

 

두 기사의 제목은 ‘이 나라 보수는 김건희 리스크를 더 이상 안고 갈 수 없다’와 ‘김건희, 사과하고 관저 떠나라’였다. 

 

김 여사는 윤 대통령의 대선이 한창일 때 논문 표절, 주가조작, 허위경력 등 논란에 휩싸인 바 있는데 2021년 12월 26일 등떠밀려 대국민 사과를 했다. 당시 김 여사는 “국민 여러분께 진심으로 사죄의 말씀을 드린다. 저 때문에 남편이 비난받는 현실에 너무 가슴이 무너진다”며 “과거의 잘못을 깊이 반성하고, 국민의 눈높이에 어긋나지 않도록 조심, 또 조심하겠다”고 했다. “남편이 대통령이 되더라도 아내의 역할에만 충실하겠다”고 말했다. 

 

모두가 알고 있는 것처럼 그는 아내의 역할에만 충실하는 대신 마치 자신이 대통령인양 행동했다. 대통령실 공식 웹사이트의 대통령 활동 사진 섹션을 보면 김건희 여사 활동 사진이 지나칠 정도로 많이 게재되어 있었다. 대통령 아내의 활동이 대통령실 웹사이트에 이렇게 많이 게재되는 것은 유례 없는 일이다. 

 

더욱 심각한 것은 최재영 목사의 뒷말이다. 그는 김용민TV ‘카이로스’에 출연, “(핵심은) 김 여사가 고급 명품 화장품과 가방을 받았느냐가 아니다. 김 여사가 국정에 개입한 것, 즉 접견 과정에서 인사 청탁 받는 것을 내 눈과 귀로 목격한 것이 본질이다. 이렇게 되면 윤석열 정부는 심각한 상황을 만날 것이다. 명품 수수는 그 다음 문제다”라고 말했다.

 

단순히 선물을 받은 것도 잘못된 일인데 김건희 여사가 인사 청탁과 연루되어 있을 수도 있다는 게 충격적인 일이다. 명품 수수와 국정 개입뿐만 아니라 영분인이 되기 전 김 여사의 이슈는 지금도 세인에 회자되고 있다. 

 

강득구 더불어민주당 의원, 안진걸 민생경제연구소 소장, 오동현 변호사는 ‘윤석열 대통령 (김건희) 특검 거부 규탄’ 기자회견에서 윤 대통령을 강하게 비판한 인물들이다. 

 

안진걸 소장은 “김건희 주가 조작 혐의 수사를 미루고 미루다가 결국 뒤늦게 수사에 일부 착수했는데, 권오수 (도이치모터스 회장) 일당을 기소한 게 2021년 겨울이 다되었던 시기다. 추가 수사가 필요했는데 이미 그때는 대통령 경선 시기였고 곧 대통령 선거시기가 됐다. 후보 배우자에 대한 수사를 진행할 수 없는 상황이었다. 당시 문재인 정부와의 극심한 대립각 속에서 검찰의 상당수가 윤석열 한동훈 편을 들어주면서 수사를 전혀 진행하지 않았다. 김건희 여사에 대한 단 한 번의 소환과 압수나 휴대폰 분석이 진행되지 않았다. 그런 상황이었는데 수사가 되었다고 거짓말을 하면 안 된다”라고 지적했다. 

 

안 소장은 “제가 도이치모터스 주가 조작 사건의 유죄 판결문을 분석해보았다. 김건희 여사 이름이 무려 37번 언급된다. 김건희 여사 계좌가 여러 개 있는데 그중에 3개는 주가조작에 사용된 것이라고 판사는 지적한다. 통정매매 중 48건이 김건희 여사의 계좌를 통해 이뤄졌다고 나온다. 누가 주범인가. 김건희 엑셀 파일도 확인이 됐는데 뉴스타파의 보도에 따르면 김건희 여사 기소가 안 되어서 유죄 선고가 안 나와 있다. 이 사건에서 김건희 여사의 역할은 무엇이었는가. 김건희 여사는 증권사 직원하고 바로 기다렸다는 듯이, 10만주를 직원이 냈다고 하니까, 그거 누가 가져갔네요, 직원이 말하자마자 기다렸다는 듯이 체결됐다. 이미 통정매매에서 매도를 자기들이 내면 바로 10만주를 사간다는 것을 너무나 잘 안다는 녹취록이 검찰 수사 기록이 공개되었다. 검찰이 알고도 덮었다는 강력한 증거이다.”라고 강조했다. 

 

안 소장은 이런 내용이 유죄 판결문에 나온 것이고 다른 하나는 검찰 수사 녹취록에 있는 것이기에 김건희 여사의 주가조작 참여는 확실해 보인다고 말했다. 그리고 그는 직원과 여러 통화 녹취록이 속속 공개되고 있다고 전했다. 통정매매, 부당이득을 김건희 여사가 자세히 알고 있다는 것이 녹취록에 나온다고 안 소장은 말했다. 그리고 안 소장은 “그가 주범이 아니면 누가 주범입니까”라고 물었다. 

 

검사들의 검사로 알려진 오동현 변호사는 같은 회견에서 “특검은 받아야 하고 명품백은 받지 말았어야 했다. 가방만 받고 특검은 거부권을 행사했다. 특검을 거부하는 자가 범인이라고 윤석열 대통령은 말했다. 죄가 있으니 특검을 거부한다고 했다. 김건희 여사는 이에 대한 예외인가. 해외 순방을 하면서 수백억 원의 혈세를 낭비하면서도 해외순방을 함께 다닌 배우자의 주가조작 의혹에 대한 특검은 세금 낭비라고 한다. 이는 국민보다 김건희 여사의 안위가 최우선이라고 생각하고 국민을 완전히 무시하고 국민과의 전면전을 선택한 것이다. 역대 어느 대통령도 본인과 본인 가족에 대한 특검과 검찰의 수사를 거부한 사람은 단 한 명도 없다. 윤 대통령이 첫 사례가 된다. 국민은 이를 기억할 것이다. 법 앞에 누구도 예외가 없다고 주장했던 윤 대통령은 정작 김건희 여사에 대한 특검은 이해할 수 없는 이유로 거부했다. 공정과 상식보다 최우선의 가치는 김건희 여사인가. 우리는 절대 이대로 물러서면 안 되고 특검법이 관철되도록 해야 한다”라고 말했다.

The video, made public on November 27 by Voice of Seoul, shows Pastor Choi purchasing the handbag from a department store and subsequently handing it over to the First Lady. This revelation has intensified scrutiny of the First Lady’s conduct and raised questions about compliance with anti-corruption laws, specifically the Kim Young-ran Act, which strictly regulates gifts to public officials and their families.

 

Lee’s column continues, "If this matter is swept under the rug, how can we demand compliance with the Kim Young-ran Act from public officials' spouses nationwide? The Anti-Corruption and Civil Rights Commission must swiftly investigate both the giver and receiver for potential legal violations. This scandal betrays the trust of citizens who supported a regime change with their votes."

 

Chosun Ilbo’s chief editorial writer, Yang Sang-hoon, also expressed concern in his column, "The position of the First Lady inherently attracts public scrutiny and accountability. However, Kim’s actions seem to be free of responsibility. Many are worried about this imbalance."

 

Headlines from both papers echoed the sentiment, with Dong-A Ilbo declaring, "Conservatives Can No Longer Bear the Kim Keon-hee Risk," and Chosun Ilbo urging, "Kim Keon-hee, Apologize and Leave the Residence."

 

Kim Keon-hee has previously faced allegations of plagiarism, stock manipulation, and falsification of academic credentials, culminating in a public apology on December 26, 2021.
